I am writing in opposition to the proposed Zoning Map Amendment #07-31, including the proffer that was received after the close of record period which ended on Wednesday, July 9, 2008 at 4:30 p.m. I’d like to remind you that the only issue before you is whether the original zoning of the Jenkins property was a mistake, or if there has been a significant change in the character of the neighborhood. Since there was no mistake in the original zoning and I’ve been told by someone from the Maryland Department of Planning that the Hughesville Bypass does not represent a significant change in the character of the neighborhood it would seem to me the proffer is irrelevant.
Furthermore, it seems to me that re-opening the public record to allow new information to be submitted without the benefit of a public hearing is not the appropriate legal procedure to follow. How is the majority of the public to know what this new information is and what exactly it means in regard to the proposed application? Certainly, the Public Notice does not inform anyone what this new information is. In addition, I feel the proffer represents an amendment to the application and should require the applicant to withdraw the pending application and file a new application.
Citizen comments were not allowed after the close of record and Mr. Chaney’s proposed proffer should not have been allowed either. I’d like to remind you again, that you have the responsibility to represent the citizens of Charles County. I ask that you consider all the facts that have been provided to you, including the letter from the Maryland Department of Planning. In doing so, I believe the facts are there to warrant denial of the above referenced application.
